Terms and Conditions of entry

  1. Information on how to enter and the prize forms part of these Terms and Conditions of entry. Entry into this competition is deemed acceptance of these Terms and Conditions of entry.
  2. The Promoter is Sunsuper Pty. Ltd. ABN 88 010 720 840, as Trustee and issuer for the Sunsuper Superannuation Fund, ABN 98 503 137 921, 30 Little Cribb Street, Milton QLD 4064, phone 13 11 84.
  3. Entry is only open to current Sunsuper members who are:
    • residents of Australia;
    • 18 years of age or older as at 30/11/2011;
    • have been extended an offer to participate in this competition via a personalised letter.
  4. Directors, management, employees (and their immediate families) of the Promoter, Sunsuper Pty Ltd, and other agencies associated with this competition are not eligible to enter this competition.
  5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter also reserves the right to request the winner to provide proof of identity, proof of residency at the nominated delivery address, and/or proof of valid entry.
  6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  7. In order for an eligible entrant to obtain an automatic entry to the competition, Sunsuper (the Promoter) must receive a ‘Super Guarantee’ contribution made by an employer on behalf of the eligible entrant by 3.00 pm (Queensland time) on 04/05/2012.
  8. Entry in this competition is free of charge.
  9. There is only one entry per Sunsuper member.
  10. The competition commences on 30/11/2011 at 9.00am (Queensland time) and concludes on 04/05/2012 at 3.00pm (Queensland time).
  11. The draw will take place on 18/05/2012 at 10.00am (Queensland time) at Sunsuper Pty. Ltd., Level 5, 30 Little Cribb Street, Milton, QLD 4064.
  12. The first valid entry randomly drawn will win one 16GB WiFi Apple iPad valued at $579 including GST.
  13. The winning entrant will be notified in writing by the Promoter within two days of the date of the draw. The Promoter will supply the winning entrant with their prize via delivery to an agreed address (at no cost to the winning entrant).
  14. The winner of the competition will be published in The Australian newspaper on 23/05/2012.
  15. If the Promoter is unable to contact the winner by phone, email or letter within three (3) months from the original draw, the Promoter will conduct an unclaimed prize draw to redraw a winner from all valid entries received during the competition period on 20/08/2012 at 10:00am (Queensland time). Any winner resulting from the unclaimed prize draw will be published in The Australian newspaper on 29/08/2012.
  16. The Promoter may draw additional reserve entries for each draw and record them in case of an invalid entry.
  17. The Promoter also accepts no responsibility for late, misdirected entries, or entries not received from any reason during the competition period, or for any periods of unavailability or technical difficulties with the entry mechanism.
  18. The prize value is the recommended retail value as provided by the prize supplier and is correct at the time of printing. The prize value is in Australian Dollars.
  19. The prize cannot be taken as cash and is not transferable or exchangeable.
  20. In the event that the prize is not available at the time of the draw, a prize of equal or greater value will be offered to the winner, subject to any written directions from a regulatory authority.
  21. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
  22. The Promoter takes no responsibility for the prize being damaged in transit or for any delay in delivery of the prize that is beyond its control.
  23. Nothing in these Terms and Conditions of entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
  24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of entry; (e) any tax liability incurred by the winner or an entrant; or (f) use of the prize.
  25. All entries become the property of the Promoter. By entering this competition, entrants understand and agree that the Promoter may use and disclose their name and postcode for the purposes of publishing them as the winner as outlined in these Terms and Conditions of entry. If entrants do not wish for their name and postcode to be published, entrants should notify the Promoter. Entrants should direct any request to opt out, access, update or correct information to the Promoter.
  26. ‘iPad’ is a trademark of Apple Inc. Apple Inc. is not a participant in or sponsor of this competition.
