Terms and Conditions of Entry

  1. Information on how to enter and prizes forms part of these Terms and Conditions of Entry. Entry into this competition is deemed acceptance of these Terms and Conditions of Entry.
  2. The Promoter is Sunsuper Pty. Ltd. ABN 88 010 720 840, as Trustee and issuer of the Sunsuper Superannuation Fund, ABN 98 503 137 921, 30 Little Cribb Street, Milton QLD 4064, phone 13 11 84.

  3. Eligibility to enter competition

  4. Entry is only open to Australian companies with an active ABN status that:
    • are paying super guarantee ‘SG’ contributions for 1 to 50 employees to Sunsuper,
    • have received an email or letter from Sunsuper containing details of this competition, and
    • have not paid ‘SG’ contributions using BPay between 1 January 2011 and 30 April 2011, and
    • have not logged onto Employer Online between 1 January 2011 and 30 April 2011;
    (“Eligible Company”).
  5. Only one (1) entry per Eligible Company.
  6. Any company that is a current supplier of services to the Promoter or any company that has a current ongoing service-supply relationship with the Promoter and other agencies associated with this competition are not eligible to enter this competition.
  7. The Promoter reserves the right, at any time, to verify the validity of entries Eligible Companies and their authorised representatives (including an Eligible Company’s place of business and an authorised representative’s identity, age, place of residence and place of employment) and to disqualify any Eligible Company whose authorised representative submits an entry that is not in accordance with these Terms and Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter also reserves the right to request winning companies (or their authorised representatives) to provide proof of identity, proof of residency/business at the nominated delivery address, and/or proof of entry validity.
  8. If there is a dispute as to the identity of an Eligible Company or its authorised representative, the Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Company or its authorised representative.
  9. Competition commences on Monday 10 October 2011 at 9:00am (AEST) and concludes on Friday 28 October 2011 at 5.00pm (AEST). Entries received after this time and date will not be considered.

  10. Submission of entry

  11. To enter the competition and be eligible to win, an authorised representative of an Eligible Company must, on behalf of the Eligible Company:
    1. make an employer-paid ‘SG’ contribution so that the contribution is received by 5:00pm (AEST) on 28 October 2011 via BPay; or
    2. fully complete and submit an Employer Online Join form via mail to GPO Box 2924 Brisbane QLD 4001 or Reply Paid 2924 Brisbane QLD 4001so that the fully completed form is received by last mail received on 28 October 2011; or
    3. visit www.sunsuper.com.au and log on to ‘Employer Online’ with their account details by 5:00pm (AEST) on 28 October 2011.
  12. Incomplete or indecipherable entries will be deemed invalid.
  13. Entry in this competition is free of charge; however, any cost associated with accessing the competition website is the responsibility of the Eligible Company and is dependent on the Internet service provider used.

  14. Draws

  15. All draws will take place on Thursday 17 November 2011 at 2.00pm (AEST) at Sunsuper, 30 Little Cribb Street, Milton QLD 4064.
  16. The name of the winning company for the Sunsuper Employer Win Your Choice of a Coffee Machine or Laptop competition will be published in issue 24 of Sunsuper’s eNews and in The Australian on Friday 9 December 2011.
  17. The winning company will be notified by the Promoter by phone within two business days of the competition draw date and by email. The Promoter will supply the winning company with their prize via delivery to an agreed address (at no cost to the winning company) by Wednesday 30 November 2011.
  18. If the prize remains unclaimed by 2.00pm (AEST) on Friday 17 February 2012, an unclaimed prize draw will take place at 3.00pm (AEST) on 17 February 2012, at the same place as the original draw. The first valid entry drawn and successfully contacted by phone and email will win the prize. The winning company from the unclaimed prize draw will be published in The Australian on Friday 02 March 2012.
  19. The Promoter may draw additional reserve entries for each draw and record them in order in case an invalid entry or ineligible company is drawn.

  20. Prizes

  21. The first valid entry randomly drawn in the prize draw will receive either a coffee machine or a laptop computer of the winning company’s choice, up to the value of $2,000 incl. GST. The exact brand, model number and/or specifications of the prize will be determined by the Promoter in agreement with the winning company, but in the event that agreement cannot be reached, the Promoter reserves the right to determine the exact brand model number and/or specifications of the prize awarded. Any difference between the value of the prize and the $2,000 amount will be forfeited and cash will not be awarded in lieu of the balance.
  22. The prize will be awarded to the owner of the respective winning company.
  23. The prize cannot be taken as cash and is not transferable.
  24. The prize is subject to the standard terms and conditions of individual prize and service providers.
  25. The Promoter takes no responsibility for any delayed delivery of the prize that is beyond its control.
  26. Subject to the unclaimed prize draw clause, if for any reason the winning company does not take the prize by the time stipulated by the Promoter, then the prize will be forfeited.
  27. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  28. Total prize pool value is up to $2,000 (GST inclusive).
  29. As a condition of accepting the prize, an authorised representative of the winning company must sign any legal documentation as and in the form reasonably required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  30. Miscellaneous

  31. The Promoter’s decision is final and binding and no correspondence will be entered into.
  32. The Promoter accepts no responsibility for late, misdirected entries, or entries not received for any reason during the competition period, or for any periods of unavailability or technical difficulties with the online entry mechanism.
  33. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend, subject to any written directions from a relevant regulatory authority.
  34. If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Company and/or its authorised representative; or (b) to modify, suspend, terminate or cancel the competition, as appropriate, subject to any written directions from a relevant regulatory authority.
  35. Nothing in these Terms and Conditions of Entry limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.
  36. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Sunsuper Employer Win Your Choice of a Coffee Machine or Laptop competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions of Entry; (f) any tax liability incurred by a Eligible Company and/or its authorised representative; or (g) use of the prize.
  37. All entries become the property of the Promoter. By entering this competition, authorised representatives of Eligible Companies understand and agree that the Promoter may use and disclose their company name and postcode for the purposes of publishing the winning company as outlined in these Terms and Conditions of Entry. If authorised representatives of Eligible Companies do not wish their company name and postcode to be published, authorised representatives of Eligible Companies should notify the Promoter. Authorised representatives of Eligible Companies should direct any request to opt out, access, update or correct information to the Promoter.
